1. Services
JDM Jom Digital Marketing (003395916-U) provides digital marketing services including website development, SEO, paid advertising, AI automation, lead generation, conversion optimisation, and CRM automation. Specific deliverables, timelines, and pricing are defined in individual service agreements or proposals.
2. Payment terms
- One-time projects: 50% deposit upon agreement, 50% on delivery
- Monthly retainers: invoiced monthly, due within 7 days of invoice date
- Late payments may result in service suspension after 14 days
3. Client responsibilities
Clients are responsible for:
- Providing timely access to required accounts and assets
- Providing accurate business information and approving deliverables promptly
- Ensuring all content provided is legally owned or licensed
4. Intellectual property
Upon full payment, clients own the final deliverables created specifically for them (e.g. website code, ad creatives). JDM retains ownership of proprietary tools, frameworks, and methodologies used in delivery.
5. Results disclaimer
While we strive to deliver measurable results and offer a 90-day results guarantee on retainer engagements, digital marketing outcomes depend on multiple factors including market conditions, competition, and business operations. Past results do not guarantee future performance. Our 90-day guarantee applies to agreed KPIs defined in the service agreement.
6. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the engagement. This includes business strategies, client data, and financial information.
7. Termination
Monthly retainer agreements require 30 days written notice for termination. Work in progress will be delivered or compensated pro-rata. One-time projects may be cancelled before delivery commencement with full deposit refund; after commencement, the deposit is non-refundable.
8. Governing law
These terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
